 ("we", "us", "our"). We offer the Site, together with all information, tools and services available through it, to you ("you", "User"), on condition that you accept all the terms, conditions, policies and notices stated here.

By visiting the Site or buying anything from us, you use our "Service" and agree to be bound by these Terms of Service ("Terms"), including the policies referred to here or linked from the Site, such as our Privacy Policy, Shipping Policy and Return & Refund Policy. These Terms apply to every user of the Site, including browsers, customers and contributors of content.

Please read these Terms carefully before using the Site. If you do not agree to all of them, you must not access the Site or use any Service. Any new feature or tool added to the Site is also governed by these Terms.

We may update these Terms by posting the revised version on this page. Your continued use of the Site after a change means you accept it. Our store runs on the Shopify platform , which provides the e-commerce technology we use to sell to you.

1. Eligibility and Online Store Terms

By agreeing to these Terms, you confirm that you are at least 18 years old and legally capable of entering a binding contract under the Indian Contract Act, 1872. Minors may use the Site only under the supervision and with the consent of a parent or legal guardian, who is responsible for their use.

You may not use our products or Service for any illegal or unauthorised purpose, and you may not violate any law of your jurisdiction (including copyright law) while using the Service.

You must not transmit worms, viruses or any code of a destructive nature. Any breach of these Terms may result in immediate termination of your access to the Service.

2. General Conditions

We reserve the right to refuse service to anyone, at any time, for lawful reasons, including suspected fraud, abuse or breach of these Terms.

Your content (excluding payment card details) may be transferred unencrypted and may be changed to fit the technical requirements of connecting networks or devices. Payment card details are always encrypted in transit.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any part of the Service, its use, or access to it, without our express written permission.

Headings in these Terms are for convenience only and do not limit or affect their meaning.

3. Accuracy, Completeness and Timeliness of Information

We try to keep the information on the Site accurate, complete and current, but we do not guarantee that it is. Material on the Site is provided for general information and should not be your only basis for a decision without checking primary or more up-to-date sources. Any reliance on it is at your own risk.

The Site may contain historical information that is not current and is provided for reference only. We may change the Site's content at any time but are not obliged to update it, and you are responsible for checking for changes.

4. Modifications to the Service and Prices

Prices of our products may change without prior notice, but the price shown at the time you place an order is the price you pay for that order, subject to Section 11 (errors).

We may modify or discontinue the Service, or any part of it, at any time. Where a change affects an order you have already placed and paid for, we will tell you and offer you a cancellation and refund.

Except as required by law, we are not liable to you or any third party for a modification, price change, suspension or discontinuance of the Service.

5. Products, Orders, Billing and Payments

Products. Some products may be available only online and in limited quantities. We try to show product colours and images as accurately as we can, but we cannot guarantee that your screen will display them exactly. We may limit sales of any product to any person, region or jurisdiction, limit quantities, and discontinue a product at any time. Offers are void where prohibited.

Orders. Placing an order is an offer to buy. A contract is formed only when we confirm dispatch of your order, not when you receive an automated acknowledgement. We may refuse or cancel any order, and may limit quantities per person, household or order, including orders from the same account, payment method or address. If we cancel or change an order, we will try to notify you by the email, phone number or billing address you gave us, and refund any amount already paid. We may restrict orders that appear to come from resellers or distributors.

Accurate information. You agree to give current, complete and accurate purchase and account information, and to update it promptly (including email address and payment details) so we can complete your transactions and reach you.

Payments. Prices are shown in Indian Rupees (INR) and, unless stated otherwise, include applicable GST. Payments are processed by third-party payment gateways. We do not store your full card, UPI or bank details. You confirm that you are authorised to use the payment method you choose. For cash-on-delivery orders, [we may charge a handling fee . COD is available only for eligible pin codes].

Quality. We do not warrant that products or information will meet your expectations or that errors in the Service will be corrected. This does not limit any right you have under the Consumer Protection Act, 2019 or other law.

6. Shipping, Returns, Cancellations and Refunds

We ship to the locations listed at checkout. Delivery timelines are estimates, not guarantees, and may be affected by courier delays, weather, public holidays or events beyond our control. Risk in the goods passes to you on delivery.

Returns, exchanges, cancellations and refunds are governed by our Return & Refund Policy  which forms part of these Terms. Refunds are made to the original payment method within 7 business days of us approving the refund, unless you agree to another method.

Please inspect your parcel on delivery and report any damage, defect or wrong item within 1 days at care.gadbadjhaala@gmail.com with your order number and photos.

7. Optional Tools and Third-Party Links

We may give you access to third-party tools (for example payment, delivery-tracking or review tools) that we do not monitor or control. These are provided "as is" and "as available", without warranties or endorsement, and you use them at your own risk. Review the terms of the relevant provider before using them. New features or services we add are also subject to these Terms.

The Site may link to third-party websites or include third-party materials. We are not responsible for their content, accuracy, products or practices, and we are not liable for any harm or damage from purchases or transactions you make with them. Please read their policies first, and direct complaints about third-party products to the third party.

8. User Comments, Reviews and Submissions

If you send us creative ideas, suggestions, reviews, photos or other material, whether online, by email, by post or otherwise (together, "comments"), you agree that we may edit, copy, publish, distribute, translate and use them in any medium without restriction and without paying you, and that we need not keep them confidential or reply to them.

We may, but are not obliged to, monitor, edit or remove content that we consider unlawful, offensive, threatening, defamatory, obscene or in breach of anyone's rights or these Terms.

You confirm that your comments will not infringe any third party's rights (including copyright, trademark, privacy or personality rights), will not contain unlawful, abusive or obscene material, and will not contain viruses or malware. You may not use a false email address, impersonate anyone, or mislead us or others about the origin of a comment. Reviews must be genuine and based on your own experience. You are solely responsible for your comments and their accuracy, and we assume no liability for comments posted by you or others.

Your personal information submitted through the Site is handled according to our Privacy Policy, which is part of these Terms. We process personal data in line with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 and the rules under them.

10. Intellectual Property, Errors and Prohibited Uses

Intellectual property. All content on the Site, including text, images, logos, product designs, graphics and software, belongs to us or our licensors and is protected by Indian and international intellectual property law. You may view it for personal, non-commercial use only. You may not copy, modify, distribute or use it commercially without our written permission.

Errors, inaccuracies and omissions. The Site may occasionally contain typographical errors or omissions in product descriptions, pricing, promotions, shipping charges, transit times or availability. We may correct them and may cancel or update an order if the information was wrong, including after you have placed it. If we cancel an order you have already paid for, we will refund you in full. We are not obliged to update or clarify information on the Site except as required by law, and no "last updated" date means everything has been refreshed.

Prohibited uses. In addition to other prohibitions in these Terms, you may not use the Site or its content:

• for any unlawful purpose, or to solicit others to carry out unlawful acts;
• to violate any law, regulation or local ordinance;
• to infringe our intellectual property rights or those of others;
• to harass, abuse, insult, harm, defame, intimidate or discriminate on grounds such as gender, sexual orientation, religion, ethnicity, caste, race, age, national origin or disability;

We may terminate your use of the Service for any prohibited use.

11. Disclaimer of Warranties, Limitation of Liability and Indemnification

We do not guarantee that your use of the Service will be uninterrupted, timely, secure or error-free, or that results from using it will be accurate or reliable. We may suspend the Service for periods of time, for maintenance or other reasons. To the extent permitted by law, the Service and all products delivered through it are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement.

To the maximum extent permitted by law, we and our directors, officers, employees, affiliates, agents, contractors, suppliers and service providers are not liable for any indirect, incidental, special, punitive or consequential damages, including lost profits, revenue, savings or data, arising from your use of, or inability to use, the Service or any product bought through it. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including your rights as a consumer under the Consumer Protection Act, 2019.

You agree to indemnify and hold harmless SAP Creations, its parent, subsidiaries, affiliates, partners, officers, directors, employees, agents, contractors and suppliers against any third-party claim or demand, including reasonable legal fees, arising from your breach of these Terms or the documents they incorporate, or your violation of any law or third party's rights.

12. General Provisions

Severability. If any provision of these Terms is found unlawful, void or unenforceable, it will be enforced to the fullest extent the law allows, and the rest of the Terms remain valid.

Termination. These Terms apply until ended by you or us. You may end them at any time by telling us you no longer wish to use the Service or by ceasing to use the Site. We may suspend or terminate your access if you breach, or we reasonably suspect you have breached, these Terms. Obligations that arose before termination, including payment for orders, survive it.

Entire agreement. Our failure to enforce any right or provision is not a waiver of it. These Terms and the policies posted on the Site are the entire agreement between you and us and replace all earlier agreements, communications and proposals about the Service. Ambiguities will not be interpreted against us as the drafter.

Governing law and jurisdiction. These Terms are governed by the laws of India. The courts at [New Delhi] have exclusive jurisdiction over any dispute arising from them, subject to any right you have as a consumer to approach a forum permitted under the Consumer Protection Act, 2019.

Grievance officer. In line with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, complaints may be sent to our Grievance Officer at care.gadbadjhaala@gmail.com. We will acknowledge complaints within 48 hours and resolve them within one month.

Changes to these Terms. We may update, change or replace any part of these Terms by posting the changes on this page. Please check it periodically. Continued use of the Site after changes are posted means you accept them.
